Yulia Fedorenko is a Senior Associate specialising in partnership and employment law.

Yulia advises both employers and senior executives on contentious and non-contentious employment matters, including whistleblowing, discrimination, harassment, settlement agreements and negotiated exits. Yulia has particular experience and interest in whistleblowing in the financial sector.

Yulia also has experience with Employment Tribunal disputes and Alternative Dispute Resolution, such as private and judicial mediation.

Yulia has advised employers on responding to Data Subject Access Requests, the conduct of workplace investigations, termination of employment, and redundancies.

Yulia also advises partners, LLP members, LLPs and partnerships on a range of issues in employment and partnership disputes and exits.

RECENT MATTERS

Partnership

  • Advising an Indian law firm on reviewing and updating their partnership agreement following the proposed changes to remuneration and governance structure. The scope of work involved updating the partnership agreement with ‘best practice’ for international law firms and ensuring that it aligns with the Indian legal market.
  • Advising a medium-sized law firm on amending their LLP agreement and Members’ Handbook in accordance with recent law developments and modern market standards.

Senior Executive

  • Advising a CEO of a global company on his transition into the role of Chairman. Advice included review and amendments to his settlement agreement, undertakings and appointment letter. In addition, the client was advised on the company’s share option plan and the company’s articles as he was a majority shareholder.
  • Advising a senior executive of a fund management company on various incentive schemes, in particular, on a “bad leaver” and a “good leaver” provisions and their effect on their prospective employment.
  • Advising a CEO of a government-owned organisation in respect of Employment Tribunal claim with the executive being named as a respondent.

Employer

  • Advising a law firm on an internal investigation pertaining to allegations of sexual harassment. The scope of work included: drafting terms of reference, instructions to Counsel, advice on a potential disability claim of the alleged perpetrator, and various data protection issues.
  • Advising a private equity recruitment agency on the recruitment of a candidate who was subject to stringent restrictive covenants. The agency sought advice on the enforceability of the covenants, in particular, the non-compete restriction. We provided the agency with legal and strategic advice, which also included practical and business considerations.
  • Advising a medium-sized law firm on allegations of a sexual nature, which are also being investigated by the police. Liaising with external an investigator and criminal solicitor to provide the client with unified advice on various aspects of the investigation. The scope of work also included advice on suspension, potential refusal to participate in the investigation and potential sexual harassment claim.

  • Advising a law firm in respect of its reporting obligations to the SRA in light of allegations of sexual harassment and the subsequent investigation.
  • Advising the London branch of a German-headquartered bank on the rules pertaining to regulatory references in the financial sector.
