IN-HOUSE LAWYERS

In recent years there has been an increased focus on in-house lawyers, with the SRA recently publishing guidance aimed at helping them reconcile their obligation to act in the best interests of their client with their regulatory obligation to act with independence and in a way which promotes the wider public interest.

We have experience in advising in-house lawyers/General Counsel on steps that they can take when they are facing pressure to act in a way which could put them into conflict with their regulatory obligations, and potential whistleblowing protections which may be available. We can also advise on continuing competence with SRA regulation for in-house lawyers and provide training.

For more information or to discuss an issue you are having, please contact Beth Hale, Andrew Pavlovic or Nick Leale.

RECENT MATTERS
  • Advising a General Counsel who had raised regulatory concerns on whistleblowing and other protections.
  • Advising in-house lawyers operating from an unregulated business on their obligations as regulated individuals, and drafting their handbook.
  • Advising an in-house lawyer on his own self-reporting obligations following allegations of misconduct.
  • Advising a COFA on the operation of client account under the SRA Accounts Rules and on the risk of using client account as a bank account.
