Please exercise caution when using AI tools to prepare instructions or information for the purpose of seeking legal advice. It may undermine confidentiality and legal privilege in that information.
We understand that lots of people use AI tools such as ChatGPT for quick research and drafting. Please be aware that such tools (particularly those which are freely available) make use of the data that is entered to inform future responses. If you enter confidential details (for example but not limited to, information about your legal issue, employment, partnership or regulatory situation, pay, contract, health or dispute, or your priorities in any negotiation) into a non-private AI tool, this may mean the information (and related AI results of your request) is no longer confidential or protected by legal professional privilege.
This in turn could mean that it becomes disclosable to other parties, a tribunal or court or other forum in legal or regulatory proceedings, which could adversely affect your legal position and prospects in any claim or proceedings.
In addition, entering such information into an AI tool may amount to a breach of workplace policies and your own obligations of confidentiality.
We strongly recommend that confidential information only be shared with a qualified lawyer (solicitor or barrister) who can also discuss the risks of sharing any information with AI tools.
